Mediation - Family Law

Mediation is a process where a third party neutral helps the parties come to mutual agreement.
The parties make choices and decisions regarding the outcome of their case outside of a litigation setting. Often, similar to collaborative law, the parties have more control over the process and the outcome than they do in litigation.

The Mediation Process

Parties can come to mediation with or without an attorney and mediation is usually done in an informal setting.  A mediator cannot give legal advice, but she provvides information for the parties to make decisions and negotiate fair and reasonable resolutions.
Often, parties will work with a lawyer in tandem with the mediation process. The lawyer can advise a party about the law and the legal process and can review any settlements that are reached through mediation.

Benefits of Mediation
Mediation can help the process move more quickly and can be cost effective. Because the mediation is focused on collaborative decision making and open communication, it may help to maintain relationships between the parties that may be important for them after the dispute is resolved. It is also very flexible, allowing the parties to come to creative solutions. It is also a confidential process, unlike litigation where in most cases all materials and proceedings are available to the public.
